5. Any decision taken by the User regarding the use of the services of Kay Strategies on the basis of the information offered by Kay Strategies on the Site is the personal responsibility and must be taken at the User's own risk.

6. Kay Strategies cannot guarantee that the Site and the services will be error-free and provided on an uninterrupted basis. 2. For the Candidate: Kay Strategies allows the Candidate to be in contact with Kay Strategies and the client, send a CV to Kay Strategies and subject to the client and participate in job interviews in the event of their application being retained.

F. Use of the courier service

Clients or Candidates have at their disposal on the Site, an internal messaging service. This service facilitates and allows the exchange and communication between Clients, or Candidates in the context of mission requests, or information from the client to Kay Strategies or in the context of recruitment processes.

As the recipient, Kay Strategies controls the use of the electronic messages exchanged, by the applicable legal provisions.

Clients, or Candidates, are prohibited from using the messaging system for purposes other than professional.

G. Prices and terms of payment

1. All prices indicated by Kay Strategies on the Site or in other written documents issued by Kay Strategies are indicated exclusive of VAT, which will be added at the legal rate on the day of issue of the corresponding invoice. All invoices are payable in euros. All costs included in the price are specified. Additional costs may arise, which will be indicated separately and must be paid by the Client, or Candidate.

2. Kay Strategies reserves the right to change prices at any time without notice.

3. Kay Strategies reserves the right to change these payment methods at any time at its discretion.

4. To the extent of its possibilities, Kay Strategies takes all reasonable precautions to ensure the security of payment data. In the absence of negligence on the part of Kay Strategies, it cannot be held liable for any loss that the User may suffer if a third party obtains unauthorized access to any data provided by the latter during access and registration. on the site. The User confirms that the credit or debit account used is his. All holders of credit/debit cards and other means of payment accepted on the Site are subject to validation and authorization checks by the payment manager. o Invoices must be paid according to the conditions provided for in the contracts signed between Kay Strategies and the Client.

o Invoices must be paid within 30 days of receipt of invoices sent by Kay Strategies employees.

o Payment must be made by bank transfer.

H. Obligations and Responsibilities

Obligations and liability of Kay Strategies

Kay Strategies undertakes to implement all necessary means to best ensure the provision of the Service.

In the event of non-compliance with the GTCSU by a User, Kay Strategies may unilaterally and without delay terminate the registration of any Client, or Candidate, by simple electronic notification, without prejudice to any damages that Kay Strategies could claim in compensation for the breach.

Kay Strategies cannot be held liable in the event of misuse of the Service by the User, or the theft or compromise of their connection information.

Furthermore, Kay Strategies cannot be held responsible for (i) the content of the advertisements, (ii) the content of the Identification Data and Personal Data, (iii) the total or partial non-compliance with an obligation and/or failure of the operators of the social networks through which the User is connected to the Site, and (iv) total or partial non-compliance with an obligation and/or failure of the operators of the transport networks to the Internet world and in particular of its access provider(s).

Kay Strategies may only be held liable in the event of a proven fault by the User resulting from a breach of its contractual obligations as defined herein and only for direct damages suffered by the User.

I. Exclusion of liability

1. To the fullest extent permitted by law, all liability of Kay Strategies or its affiliates is excluded for any loss or other damage suffered by the User arising out of or in connection with entering into any contract provision and use of the services offered on the Kay Strategies Site.

2. The Client, or Candidate accepts that the use of the services offered by Kay Strategies is at his own risk.

3. The Customer or Candidate cannot make a claim if the defect was caused by misuse or an accident attributable to him.

4. Delays, improper performance or total or partial non-performance of the Services of Force Majeure, and including without limitation fire, flood, strikes, regulations or requirements of public force, or any other unavoidable event , unpredictable and beyond the control of Kay Strategies cannot give rise to compensation. The provisions of this article may not, however, in any case, exempt either party from the obligation to pay the other any amount due.

K. Applicable law and jurisdiction

In the event of difficulties in the interpretation or execution of the GTCSU, the User and Kay Strategies will endeavor to settle their dispute amicably within thirty (30) calendar days from the date on which one of the parties will have notified the other of the difficulty, by registered letter with acknowledgment of receipt.

3. Any legal or arbitration dispute arising from the contractual relationship between Kay Strategies and the User under these GTCSU, or in connection with it, will be submitted to the Spanish courts.
